Prima Stone Inc., will warrant all products against delamination for a period of two (2) years from date of purchase. Shipping and handling not included in replacement of material due to a warranty claim. Prima Stone does not provide refunds. Prima Stone does not provide reimbursement for cutting or installation time as a result of a warranty claim. Please contact us at email@example.com for more details or to obtain a warranty claim form. All warranty claims must be submitted by the purchaser.
VOIDANCE OF WARRANTY
The aforementioned warranty is voidable under the following circumstances:
(i)abuse or misuse of the Product;
(ii)any reason which could be qualified as force majeure;
(iii)failure of adhesives or other bonding materials used during installation;
(iv)when Product is moved or removed from its original installation location;
(v)lack of proper care or maintenance of the Product;
(vi)the Product was used for an outdoor application; and
(vii)when Prima Stone Installation Guide is not followed.
CONDITIONS NOT COVERED BY WARRANTY
There is no warranty for staining or etching of marble, onyx or travertine.
2. NATURAL VARIANCE
Prima Stone does not warranty density nor the geological imperfections that are inherent in natural stone. As such, any surface fissuring or chipping that occurs as a result of transporting, cutting or handling by third parties is not warranted. If fissures or chips do occur, please check with your installer who can recommend service providers that are trained to repair imperfections.
Prima Stone's warranty does not extend to the work of installers. Please carefully inspect Prima Stone tile panel for deficiencies and review layout prior cutting or installation. Any deficiencies or required exchanges must be addressed with Prima Stone prior to installation.
All material is shipped FOB from the Prima Stone Warehouse. Any damages that may be caused during shipping will be covered by 3rd party delivery insurance and may take 6 weeks or more to process.
TERMS OF SALE
Full payment is required on stone to hold material. All sales final. Returns for store credit happily accepted on full panels received back in condition sold or on material that has not left our warehouse, within 60 days of purchase. Returns subject to a 25% restock fee. Custom manufactured orders cannot be exchanged. Delivery not included in sales or exchanges. Prima Stone does not guarantee delivery dates of material in transit. Prima Stone's warranty does not extend to the work of installers, nor bowing of panels due to exposure to cold weather. Please inspect Prima Stone tile panel for deficiencies and review layout prior cutting or installation. Please verify panel numbers match invoice and confirm layout with end client prior to installation. Any deficiencies or required exchanges must be addressed with Prima Stone prior to installation. Invoice based on plans and measurements provided by client. Additional material required due to site specifics not included. 3% surcharge for payment by credit card Payment due upon receipt. Interest of 2% per month or 24% per annum will be applied to accounts overdue.
Prima Stone is made from natural stone products, including but not limited to: marble, travertine and onyx. Each piece of stone is unique, and within product series there can be a great variety in veining, tint, colour and density. There can also be minor pitting and/or surface fissures, fills in stone. These variances are due to the naturally occurring conditions in which the stone has been created. None of the aforementioned qualities are considered defects and will not be considered grounds for an exchange, refund, or warranty claim.
Samples provided by Prima Stone are intended to be representative of distinguishing features of the stone. Please contact Prima Stone's Order Desk for pictures of available inventory if the sample on-hand is an insufficient example of the product.
2. LAYOUT REPRESENTATION
On request, Prima Stone can provide a visual aid for understanding how Prima Stone will book-match. This is intended to help with the decision making process and streamline the estimation process. Any design layouts provided by Prima Stone are representations only and are not meant to be used to calculate quantity or as an installer's construction drawings.
Any estimates provided by Prima Stone are based on plans and/or drawings provided by the purchaser. If conditions of the project change such that more material is needed than originally estimated, it is the responsibility of the purchaser to purchase additional material. Prima Stone does not accept responsibility for providing additional material beyond what has been purchased.
Prima Stone does not provide installation services. Upon request, Prima Stone can provide clients a list of installers who are trained to work with Prima Stone products. Installers are independent contractors, and Prima Stone does not offer warranty on the installation services provided by third parties.
5. VARIANCE IN STONE
Prima Stone panels can vary slightly in thickness (up to 1/16"). This is an allowable variance per MIA standards. Prima Stone panels installed with a joint may require require additional polishing at the seams.
6. HOLDING MATERIAL
Full payment is required to hold material that is currently in stock. Prima Stone is not responsible for paid panels left in our warehouse over 90 days.
7. DELIVERY AND FINAL SALE
Delivery is not included in sales nor exchanges. Additional freight charges will apply to custom manufactured orders. Delivery is FOB after leaving the Prima Stone Warehouse. Damages caused during shipping will be covered by delivery insurance and may take 6 weeks or more to process. All sales are final. Exchanges are accepted on material that is returned in condition noted on "Acknowledgement of Receipt". Custom manufactured orders cannot be exchanged.
9. CUSTOM MANUFACTURED AND CUT ORDERS.
Custom orders will be manufactured to specifications on purchaser provided "cut sheet' prepared and approved by the purchaser in auto cad with a copy in PDF. Orders will be true within 1mm +/-. If there are any discrepancy between "cut sheet" and final product our resolution process will be as follows:
a) At Prima Stone's sole discretion, working with the purchaser locally, using existing material to resolve (ie recutting locally, etc).
b) If local rectification is not possible, replacement material will be provided. This may take 6-12 weeks to process.
With regards to colour/ veining/ natural variations, if there is a significant perceived variation, replacement material may provided at Prima Stone's sole discretion. Replacement material, if not in stock, may take 6-12 weeks to process.
10. CONFLICT OF TERMS
In the event of any conflict between the terms and conditions contained in the relevant sales invoice from Prima Stone Inc., the terms and conditions of a relational contract, and/or the terms and conditions of the Company's Terms of Sale and Warranty document, the terms and conditions contained in the relevant sales invoice shall prevail.
11. In the event that a REFUND is offered at the sole discretion or Prima Stone, due to a resolution of warranty claim, refunds will take 30-90 days to be returned.
THE WARRANTIES SET FORTH ABOVE ARE THE SOLE WARRANTIES PROVIDED BY PRIMA STONE INC., AND SHALL EXTEND ONLY TO THE ORIGINAL PURCHASER OR PURCHASERS CLIENT.
ALL IMPLIED WARRANTIES are excluded. In no event shall Prima Stone Inc., be liable for incidental or consequential damages.
